Landlord-Tenant Law and Least Restrictive Alternatives

This training will provide Mental Health panel attorneys with a basic understanding of landlord-tenant law to effectively dispute the assertion that “no less restrictive placement” is available for the client in the context of rental housing.

This two-hour presentation and discussion will include presentations by Anna Lembo, Esq., Worcester County Regional Coordinator and Toni Hall, Esq., Suffolk County Regional Coordinator on the following topics:

  • Creating Residential Tenancies
  • Types of Tenancies
  • Tenant Screening & Selection
  • Rental Application Process and Security Deposits
• Terminating Residential Tenancies
  • Evictions – Defenses
• Reasonable Accommodation Issues in Residential Housing
• ADA and Lead Paint Compliance
• Discrimination Issues in Residential Housing

The second hour will consist of a review of case law on least restrictive alternatives and an open discussion regarding least restrictive placement as it relates to landlord-tenant law in the mental health client context.
